In these Terms, “Kels”, “we”, “us” and “our” refer to Kels Original Ltd. “You” and “your” refer to the person using our website or purchasing from us.
Please read these Terms before placing an order.
Nothing in these Terms affects your statutory consumer rights.
1. About our website
Our website allows you to browse and purchase Kels products and access information about our brand, products and services.
Our online store is powered by Shopify, which provides the e-commerce platform we use to operate the store and process transactions.
Any contract for the purchase of Kels products through our website is between you and Kels Original Ltd, not Shopify.
By placing an order, you confirm that you are legally capable of entering into a contract and that the information you provide is accurate and complete.
2. Our products
We make reasonable efforts to ensure that product descriptions, specifications, images and other information on our website are accurate.
Colours and appearance may vary slightly depending on your screen, device and display settings.
Any minor differences caused by photography, lighting or screen settings do not affect your statutory right to receive products that are as described, of satisfactory quality and fit for their intended purpose.
Product availability can change without notice and we may discontinue products or variations at any time.
3. Placing an order
When you submit an order through our website, you are making an offer to purchase the products in your basket.
You should check your order carefully before completing your purchase.
After you place an order, you will receive an electronic acknowledgement or confirmation.
We may decline or cancel an order before dispatch in reasonable circumstances, including where:

there is an obvious pricing or product information error;

4. Prices and payment
Prices displayed on our website are shown in the currency selected for your location.
Prices for UK customers include applicable taxes where required.

We may change our prices at any time, but this will not affect an order that has already been accepted, except where there has been an obvious pricing error.
Payment must be made using one of the payment methods available at checkout.
5. Promotions and discount codes
From time to time, we may offer promotions, discounts or promotional codes.
Additional terms may apply to a particular promotion and will be provided where appropriate.
Unless otherwise stated:

6. Shipping and delivery
Orders are dispatched in accordance with our Shipping Policy.
Delivery dates and times are estimates unless we have expressly agreed a guaranteed delivery date with you.
We will take reasonable steps to deliver your order within the stated timeframe.
Your order remains at our risk until it is delivered into your physical possession or the possession of a person you have identified to receive it on your behalf.
If your order is delayed, lost or damaged during delivery, please contact info@kelsoriginal.com and we will work to resolve the issue.
Your statutory rights in relation to late or failed delivery are not affected.
7. Changing or cancelling an order
We begin processing orders shortly after they are placed, so we cannot guarantee that we will be able to change or cancel an order before dispatch.
If you need to make a change, contact info@kelsoriginal.com as soon as possible.
This does not affect any statutory cancellation rights you have after placing or receiving an online order.

8. Returns and refunds
Kels offers a 30-day returns period, subject to the conditions set out in our Returns & Refunds Policy.
Our 30-day returns policy is provided in addition to your statutory consumer rights.
UK and EU consumers will generally have statutory cancellation rights when purchasing online, including the right to notify us of cancellation within the applicable cooling-off period.

9. Faulty or misdescribed products
Products supplied by Kels must meet the standards required by applicable consumer law.
For UK consumers, this includes the right to receive goods that are:

as described;

of satisfactory quality; and
-
fit for purpose.
If you believe your Kels product is faulty, damaged, not as described or otherwise does not meet the required standard, contact info@kelsoriginal.com.
Depending on the circumstances, you may have statutory rights to a refund, repair, replacement or price reduction.
These statutory rights exist independently of any additional Kels warranty.
10. Kels 2-Year Warranty
Kels sunglasses are backed by a 2-year warranty, subject to the applicable warranty conditions.
This warranty is an additional benefit provided by Kels and does not replace, restrict or reduce your statutory consumer rights.
If you believe your product has developed a fault covered by the warranty, contact info@kelsoriginal.com with your order number and details of the issue.
We may request photographs or other reasonable information to help us assess a warranty claim.
11. Website content and intellectual property
Unless otherwise stated, the content of the Kels website, including our name, logos, trademarks, product names, photography, graphics, videos, text, designs and other materials, belongs to Kels Original Ltd or is used by us with permission.
This content is protected by applicable intellectual property laws.
You may access and use our website for your own personal and non-commercial use.
You must not copy, reproduce, distribute, commercially exploit or substantially modify our website content without our prior permission, except where permitted by law.
Nothing in these Terms transfers any intellectual property rights to you.
12. Reviews, photographs and other content
If you voluntarily submit a product review, photograph, testimonial or other content to Kels for publication, you confirm that you have the right to provide that content and that it does not unlawfully infringe the rights of another person.
You grant Kels a non-exclusive, worldwide, royalty-free licence to use, reproduce and display that content for purposes connected with operating and promoting Kels, including on our website, social channels and marketing materials.
This licence does not transfer ownership of your content to Kels.
Where content contains personal information, our use of that information is also subject to our Privacy Policy and applicable data protection law.
We may remove content from our website where we reasonably consider it unlawful, misleading, abusive, infringing or otherwise inappropriate.
13. Acceptable use of our website

Our online store is powered by Shopify.
Shopify provides technology and services that enable us to operate our online store.
Your purchase of Kels products is made directly from Kels Original Ltd.
Shopify is not the seller of the Kels products you purchase from our website.

16. Our responsibility to you
We are responsible to you for foreseeable loss or damage caused by our breach of these Terms or our failure to use reasonable care and skill.
Loss or damage is foreseeable if it was an obvious consequence of our breach or if both you and Kels knew it might happen when the contract was formed.
If you are purchasing as a consumer, we do not accept responsibility for losses that are purely connected with a trade, business or profession.
Nothing in these Terms excludes or limits our responsibility where it would be unlawful to do so, including liability for:

death or personal injury caused by our negligence;

fraud or fraudulent misrepresentation;

faulty or misdescribed goods where liability cannot legally be excluded; or

Where such an event affects an order, we will take reasonable steps to minimise the impact and keep you informed where appropriate.
